TERMS AND CONDITIONS

​Please read all these terms and conditions carefully before booking to participant or attend our race(s). This document has legal consequences and will affect your rights and your ability to bring further legal actions.

​Application

​These Terms and Conditions will apply to the purchase of Event participation, Services and Goods by you (the Customer or you). We are Thunder Races Ltd, a company incorporated in England and Wales with registered number 16006927 whose registered office is at The Grange, Moor End Road, Radwell, BEDFORD,   Bedfordshire,  MK43 7HY; (the Supplier or us or we).

These are the terms on which we sell all Event participation, Services and Goods to you.  Before placing an order on our Website, you will be asked to agree to these Terms and Conditions. If you do not accept our terms and conditions, you will not be able to complete your Order.  You can only purchase the Services and Goods from the Website if you are eligible to enter into a contract and are at least 18 years old.

When entering on the day of an event, in person, by confirming your full name, DOB and email address you understand that you are agreeing to our full terms and conditions stated below.

Interpretation

Thunder Races whose office is at The Grange, Moor End Road, Radwell, Bedfordshire, MK43 7HY; Company number 16006927

“Consumer” - means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession

“Agreement” – the agreement between you and Thunder Races Ltd  comprised of the event conditions and the conditions of entry;

“DPA” – Data protection act 2018

“Booking Fee” means the fee added to the Entry Fee on booking (where applicable). This covers the administrative fee to process the entry and any associated credit card charges, and is strictly non-refundable.            

   

“Entry Form” means the website pages which a participant must complete in order to attend/participate in the Event;        

       

“Event Page” means the specific web page for the Event on events websites - www.thunderraces.co.uk

"Event participation" means taking part in any Thunder Races event, whether the place in that event is paid in full, in part or provided free of charge.

“Minimum Age” means the minimum age of entry for each Event on the Event Date, which unless specifically prescribed otherwise by Thunder Races Ltd, is 18 years old on the day in which the Event takes place.  

“Minor” means anyone between the Minimum Age and 18.      

         

“Venue” means the property on which the Event, or any element of the Event, is held

“Event Organiser/we/us/our” means Thunder Races Limited, a company registered in England & Wales with company registration number 16006927 and any of its successors, assigns or subsidiaries including, without limitation, Thunder Races Limited a company registered in England & Wales with company registration number xxx and you/your/yourself means the person named on the Entry Form who will be attending/participating in the Event.     

"Event" – Any running event, run tour, private run tour, themed run tour or canicross event organised by Thunder Races Limited; each such element shall be an Event for the purposes of these Conditions;            

   

"Event Conditions" - the terms and conditions, in addition to these Conditions of Entry, provided to you by Thunder Races Limited in respect of the Event from time to time;

"Event Date" - the announced date of the Event(s);

“Event Details” - the name, image, and event time of each participant;

"Fee" - the fee payable by you to Thunder Races Limited in consideration of your participation in the Event;

“Force Majeure Event”- means any circumstance not within a party's reasonable control including: (a) acts of God, flood, drought, earthquake or other natural disaster; (b) epidemic or pandemic; (c) terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; (d) nuclear, chemical or biological contamination or sonic boom; (e) any law or any action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition; (f) collapse of buildings, fire, road, footpath, bridleway or bridge closure, explosion or accident; (g) solely where Thunder Races Ltd  is seeking to rely on the Force Majeure Event clause, non-performance by suppliers or subcontractors to Thunder Races Ltd  or a death of a member of the Royal family; (h) athlete boycott; and (i) interruption or failure of utility service but excluding any labour or trade dispute, strikes, industrial action or lockouts;

 

“Officials”: any event officials as appointed by Thunder Races from time to time;

“Partners”: any sponsors, suppliers, licensees or partners of the event from time to time;

“Personal Data”: shall have the meaning given to it in the DPA;

“Privacy Policy”: Thunder Races’s privacy policy which can be found at https://www.thunderraces.co.uk/privacy.policy;

"you" "your" - the entrant to the Event or, where you are signing as a parent or guardian for a child aged under 18 for whom you are responsible, your child.

“Contract” - means the legally-binding agreement between you and us for the supply of the Services, goods and event participation;

“Supplier” – means Thunder Races Ltd

“Goods” - means any goods that we supply to you with the Services, of the number and description as set out in the Order;

“Order” - means the Customer's order for the Services from the Supplier as submitted on the Website;

“Website” - means our website www.thunderraces.co.uk on which the Services, events and goods are advertised.

1.0 - General

  1. If there is a conflict or inconsistency between any provision contained in the body of these Conditions of Entry and any provision contained in the Event Conditions, except where provided to the contrary in the latter, the Event Conditions prevail to the extent of the conflict or inconsistency.

  2. The Agreement shall be governed by English law, and the parties submit to the exclusive jurisdiction of the English courts.

  3. If any provision of the Agreement is invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.

  4. The Agreement does not create, confer or purport to confer any benefit or right enforceable by any person not party to it.

  5. Any breach of this Agreement shall render your entry void. If you are found to be in breach of this Agreement, Thunder Races Ltd reserves the right to exclude you from participation in the current and/or future edition of the Event and any other events held, controlled and/or operated by Thunder Races Ltd .

  6. Race rules - All participants agree to abide by the rules of the race set by the race directors, organisers (including medical staff, police and race day stewards) and that of affiliated organisations England Athletics, Trail Running Association and UK Athletics (where appropriate).

  7. Fitness to participate - All entrants understand that they bear all of the risks associated with the stress and strains of the event from a physical perspective. All participants agree that they are fit and healthy enough to compete in the event and will not hold the event organisers responsible for health failures that arise during/following the event. Additionally, entrants will not hold the organisers responsible for the loss or damage of any personal equipment left without care.

  8. These Terms and Conditions should be read alongside, and are in addition to our policies, including our privacy policy (https://www.thunderraces.co.uk/privacy.policy) and cookies policy (https://www.thunderraces.co.uk/privacy.policy).

 

2.0 Entry & Booking

  1. By submitting your entry form application you are agreeing to enter into the Event, pay the Fee to Thunder Races, participate in the Event on the Event Date(s), abide by the Rules and also to abide by these Conditions of Entry, the Event Conditions and any instructions given to you by the Thunder Races and/or officials of the Event.

  2. Where you are provided with an timing chip by Thunder Races at an event to record your time, this should be used in accordance with the instructions. Where required to do so, you agree to return the electronic chip at designated points located near to the finish line of the Event or within 30 days by post to Thunder Races, The Grange, Moor End Road, Radwell, Bedfordshire, MK43 7HY. If you fail to return the electronic chip, Thunder Races Ltd will be entitled to charge you for the replacement cost of the chip.

 

3.0 Services

  1. Services - The description of the Services, Events and any Goods is as set out on the Website, social media, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of any Goods supplied.

  2. All Services which appear on the Website are subject to availability.

  3. We can make changes to the Services, Events and any Goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

 

4.0 Event safety

  1. At all times during the Event you must adhere to all instructions given by Thunder Races and/or the Event officials from time to time.

  2. Participation in the Event is personal to you; you are strictly prohibited from swapping, selling or transferring or offering to sell, swap or transfer the place in the Event or allowing any other person to wear the Event number. Any breach of this Condition shall render the entry void. If you are found to be in breach of this Condition, Thunder Races reserve the right to exclude you from participation in future Events.

  3. You are not permitted to use the following items in the Event:

  • any wheeled device (with the exception of an approved self propelled wheelchair);

  • any artificial aid;

  • any pets or animals, with the exception of dogs at designated canicross events; or

  1. any other item that could potentially inhibit the flow or safety of other participants or which Thunder Races Ltd , in its reasonable opinion, deem may cause danger or risk of danger to you or other participants.

  2. You warrant to Thunder Races Ltd  that you will be on the Event Date, sufficiently fit and healthy to participate in the Event unaided and in accordance with the Agreement. If you are in any doubt, Thunder Races Ltd  recommends that you seek medical advice.

  3. You acknowledge and understand that the Event may be potentially hazardous and that admission to any Venue and/or participation in any Event is at your own risk.

  4. You acknowledge that the Event may involve strenuous physical exercise, loud music or other factors which could involve personal risk and you fully understand and accept that: (i) your participation in the Event may result in serious bodily injury and/or death to yourself or others; (ii) the Event may be held on public roads and facilities/areas open to the public during the Event and upon which hazards are to be expected; and (iii) where the Event involves strenuous physical exertion you may be required to be active for very long periods of time, including through inclement and/or very hot weather.     

  5.  Where the Event is outdoors you recognise that it may take place in varied or adverse weather conditions. You are expected to prepare yourself for the conditions of the day accordingly;   

  6. You consent to medical care and transportation in order to obtain treatment in the event of injury to you and waive any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury. You understand that no medical care may be available, but if it is, you assume liability for any and all medical expenses incurred as a result of your participation in the Event and any treatment you may receive. You acknowledge and understand that it is your personal responsibility to arrange for insurance cover for the Event if you wish to be covered by insurance. We will not provide insurance cover for your participation in the Event.   

  7. You understand and agree that you must fill in the contact and medical information fields on the back of your running bib. It is your responsibility to ensure that this information is correct. We will not be liable to you for any loss, damage or mis-treatment/mis-diagnosis that may result from any such information being inaccurate, misleading or incomplete.

  8. This medical information will only be used by us to assist in the giving of medical treatment, if required, during the Event.                     

  9. If you are entered into the wheelchair section of the Event (where applicable), you are only permitted to use a self-propelled wheelchair without gears or any mechanical, powered or electronic aid or device

 

5.0 Event ejection

  1. Thunder Races reserves the right to refuse entry to the Event or to ask you to cease participation if:-

    1. you fail to follow instructions given by Event officials;

      1. you attempt to participate in the Event in a manner that Thunder Races Ltd , acting reasonably, believe:-

      2. may cause injury to you or another participant;

      3. may damage or harm the environment;

      4. in Thunder Races’s opinion is likely to cause offence; or

      5. otherwise causes a risk or potential risk to health and safety.

      6. in Thunder Races’s opinion, you are unfit to participate in the Event due to:-

        1. the consumption or use of alcohol or drugs;

        2. an injury or illness; or

        3. you fail to arrive at the start location at the specified time; or

        4. you are unable to make sufficient progress in the Event to allow you to complete the Event in line with timelines set by Event officials. Competitors will only be eligible for a medal and to feature in the results if they complete the course before the advertised official cut off time on the day of the event.

  2. If you are refused entry to the Event or Thunder Races Ltd ask you to cease participation in the Event, you must remove your runner's identification number and electronic chip and return them to an Event official.

  3. Cancellation by you

  4. You should inform Thunder Races Ltd immediately in the prescribed manner if you need to withdraw for any reason. If you do so, the Fee will not be refunded. If you are unable to attend/participate in the Event for any reason you will not receive a refund of the Event Fee, any booking fee and/or any other costs you have incurred in connection with your entry into the Event.

  5. We may at our discretion allow you to transfer your Entry to a third party provided that (i) an administration fee of £10 is paid (ii) You notify us of the proposed transfer by email to info@thunderraces.co.uk (iii) The third party completes an entry form and agrees to be bound by these terms and conditions.

  6. Thunder Races Ltd strongly recommends that participants protect themselves with adequate insurance in the event that they have to withdraw from the Event due to injury, illness or other reasons.

 

7.0 Cancellation by us

  1. We reserve the right to cancel the Event if:               

  2. circumstances beyond our reasonable control arise which affect the safety and security of the participants and/or spectators or affect our ability to hold the Event, including, without limitation, war, civil or political unrest, terrorism or inclement weather conditions; or               

  3. before the Event Date we have not, in our sole discretion, received a sufficient number of applications to ensure that there are enough attendees/participants to make the Event economically viable.                

  4. The Event Organisers hold the rights to amend/cancel any event at late notice. This includes any aspect of the event such as race time, date, venue, fees or prizes.

  5. In the event of a cancellation that is beyond the control of the Event organisers, such as adverse weather conditions and communicable diseases, including Covid-19 restrictions, attempts will be made to reschedule the event, and entries will be automatically transferred. Where an event can not be rescheduled, committed contractors will be paid and remaining funds will be offered as partial refunds or donated to charity. Where an event is not fully cancelled or rescheduled and the participant chooses not to race, they will not be entitled to a refund.

  6. Thunder Races Ltd is under no obligation to hold the Event and may cancel the Event for any reason.

  7. Thunder Races may also cancel your entry if you have obtained it through a third party (such as a club, sponsor or charity) and:

    1. the third party is no longer entitled to that entry; or

    2. the third party informs us that they no longer wish for you to have that entry.

  8. In such circumstances Thunder Races Ltd will, if practicable, provide written notice of cancellation to the address Thunder Races Ltd  hold for you. In the event that written notice is not practicable due to the timescales involved, Thunder Races will use reasonable endeavours to provide other suitable methods of notice including, email, mobile phone and text messages.

  9. Should Thunder Races cancel the event for any reason, with the exception of cancellation that is beyond the control of the organiser, Thunder Races Ltd shall refund the Fee to you.

  10. In the event of cancellation of the Event for any reason, Thunder Races Ltd will not be liable for (excluding the Fee) any costs incurred as a result of cancellation including, but not limited to, any travel or accommodation costs.

In the event of cancellation of the Event for any reason, and should Thunder Races Ltd opt to provide you with a refund, Thunder Races Ltd  shall only be obliged to refund the Fee to you.

 

8.0 Privacy and Data protection

  1. Please read the privacy policy carefully to understand Thunder Races’s practices regarding your Personal Data and how it will treat it. Thunder Races Ltd  privacy policy can be found at https://www.thunderraces.co.uk/privacy.policy

  2. You agree that any audio, visual, or audio-visual recordings that you make of the Event or any part of it are for personal use only and cannot be used for commercial purpose.

  3. You agree to receive Thunder Races emails with details of our events, your emails will not be passed onto third parties unless requested.

  4. We retain and use all information strictly under the Privacy Policy.

  5. We may contact you by using e-mail or other electronic communication methods and by pre-paid post and you expressly agree to this.

 

9.0 Changes to the event

  1. Thunder Races Ltd  reserve the right to change the course, or make any other amendment to the Event that Thunder Races Ltd  deem necessary to stage the Event. Any change to the Event will be communicated to you at the Event or sooner if practicable.

  2. For the avoidance of doubt, should the course distance be reduced, you agree that the Event is still deemed to be staged and that Thunder Races Ltd  will not be liable to you for any refund.

 

10.0 Image Use

  1. The Event may be televised, filmed and/or otherwise recorded and photographs may be taken all of which may capture your participation in the Event. You agree to the publication of such photographs, filming, recording and broadcasts and their use by us and those authorised by us in any way which Thunder Races Ltd  may see fit now or in the future including but not limited to film, broadcast, radio, TV, publications and publicity.

 

11.0 Liability

  1. In no event shall THUNDER RACES LTD  be liable to you whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Agreement for any:

    1. loss or damage;

    2. loss of profit;

    3. loss of reputation;

    4. loss of business, revenue or goodwill;

    5. loss of anticipated savings;

    6. pledges made on your behalf or by you to charity; or
       

  2. Nothing in this Agreement shall affect Thunder Races Ltd liability for death or personal injury, fraud, or any other liability to the extent it cannot be excluded or limited by law.

 

12.0 Basis of Sale

  1. A Contract will be formed for the Event participation, Services or Goods ordered only when you receive an email from us confirming the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving you confirmation of the Contract by means of an email with all information in it (ie the Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the event date.

  2.  Any quotation or estimate of Fees (as defined below) is valid for a maximum period of  30 days from its date, unless we expressly withdraw it at an earlier time.

  3. No variation of the Contract, whether about description of the Event participation, Goods or Services, Fees or otherwise, can be made after it has been entered into unless the variation is agreed by the Customer and the Supplier in writing.

  4. We intend that these Terms and Conditions apply only to a Contract entered into by you as a Consumer. If this is not the case, you must tell us, so that we can provide you with a different contract with terms which are more appropriate for you and which might, in some respects, be better for you, e.g. by giving you rights as a business.

 

13.0 Fees and Payment

  1. The fees (Fees) for the Services and event participation, the price of any Goods (if not included in the Fees) and any additional delivery or other charges is that set out on the Website at the date we accept the Order or such other price as we may agree in writing. Prices for Services may be calculated on a fixed price or on a standard daily rate basis.

  2. Fees and charges include VAT at the rate applicable at the time of the Order.

  3. You must pay by submitting your credit or debit card details with your Order and we can take payment immediately or otherwise before delivery of the Services.

 

14.0 Delivery

  1. We will deliver the Services, including any Goods, to the Delivery Location by the time or within the agreed period or, failing any agreement:

a.   in the case of Services, within a reasonable time or on the booking date; and

b.   in the case of Goods, without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into.

  1. We do not generally deliver to addresses outside England and Wales, Scotland, Northern Ireland, the Isle of Man and Channels Islands. If, however, we accept an Order for delivery outside that area, you may need to pay import duties or other taxes, as we will not pay them.

  2. If you or your nominee fail, through no fault of ours, to take delivery of the Services at the Delivery Location, we may charge the reasonable costs of storing and redelivering them.

  3. The Goods will become your responsibility from the completion of delivery or Customer collection. You must, if reasonably practicable, examine the Goods before accepting them.

15.0 Governing Law

  1. These terms and conditions, their subject matter and their formation (and any non- contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

  2. If a court finds part of this contract illegal, the rest will continue in force. Each of the clauses of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.

  3. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
